The Supreme Court of Ukraine determined in which cases drivers can park on sidewalks.
The Ukrainian Supreme Court has issued a ruling that clarifies a long-standing dispute between drivers and law enforcement regarding the use of sidewalks for parking.
According to information from "Your car", this ruling was based on a case involving a Skoda Octavia driver from Kremenchug, who was fined 255 hryvnias for driving on the sidewalk. The driver disagreed with the fine and filed appeals in all judicial instances until the Supreme Court ruled in his favor and canceled the penalty.
In its ruling, the Supreme Court of Ukraine clarified that according to traffic rules, motorists are allowed to park on sidewalks if at least two meters of free space for pedestrians remains. Moreover, drivers have the right to temporarily move on the sidewalk to enter or leave a parking space.
This decision is significant for Ukrainian drivers as it clearly defines the rules for using sidewalks for parking. Now drivers can be confident that a short-term exit onto a parking sidewalk is not a violation if they comply with the conditions. This is especially relevant for cities with a small number of parking spaces, where finding a parking spot is often problematic.
It is important to note that this decision does not give drivers the right to use sidewalks unchecked. On the contrary, it emphasizes the need for careful consideration of pedestrians and their safety. Drivers must ensure that their actions do not interfere with pedestrian movement and do not endanger their safety.
This Supreme Court ruling also emphasizes the importance of drivers knowing and understanding traffic rules. It shows that in some cases what seems to be a violation is actually legal when certain rules are followed.
For police officers, this decision is also significant. It points to the need for a more attentive and differentiated approach to evaluating drivers' actions. Police officers should consider not only the fact of driving onto the sidewalk but also the purpose of this maneuver and the driver's compliance with all conditions.
It should be noted that drivers were previously urged not to rush to pay fines for improper parking.
