Why Being Off the Military Registry Doesn't Grant Soldiers the Right to Leave Service.
Military Registration and the Unique Status of Active-Duty Personnel
According to Novyny.live: Active-duty members of the Armed Forces of Ukraine are not classified as conscription-eligible citizens and are not registered with Territorial Centers for Recruitment (TCRs) while serving. However, this does not authorize them to discharge from military service. Understanding these rules is key to grasping how military status works in the country.
Under current law, individuals lose their conscription-eligible status once they begin active service. This means their position within the military registration system shifts, removing them from TCR rolls. As Iryna Mamai explained,
“if you are a service member, you are not registered with the TCR.”
When someone serves in the Armed Forces, they are removed from the military registry. Vladyslav Deriy confirmed that
“you were taken off the military registry because you are a service member, not a conscript.”This highlights the distinct conditions and registration rules that apply to military personnel.
Yet, the fact that soldiers are not listed with the TCR does not grant them the right to leave the Armed Forces. Yuriy Aivazian noted that
“that entry in 'Reserve+' does not give you the right to discharge.”Consequently, service members must maintain their status and fulfill all duties assigned during their term of service.
Shifts in Military Registration Practices
Changes to how active-duty personnel are registered underscore the need for a clear distinction between military and civilian populations regarding mobilization. These policies also reflect legislative efforts to ensure proper oversight of service members' obligations, preventing any misuse of status to evade duty during emergencies. Given the ongoing security situation in Ukraine, such regulations have become increasingly relevant as the nation continues to address challenges to its defense capabilities.
