Citizens who appear before a VLC have the right to challenge the board's decision if they were not offered surgery—a key step in determining their fitness for service.
Health Evaluations and Citizens' Rights
The VLC evaluates the physical condition of those subject to mobilization. Under Article 55 of the Disease Schedule in Ukraine's Ministry of Defense Order 402, if a hernia is detected, the conscript must be offered surgical treatment. This means that if no such treatment was proposed and the individual was still deemed fit for duty, they have grounds to appeal the commission's ruling.
“If a citizen is not offered surgery but is immediately declared fit, the VLC conclusion must be challenged,” says Vladyslav Deriy.
This underscores the importance of medical intervention for preserving the health of conscripts. Each year under martial law, citizens undergo VLC evaluations, making this process especially significant.
A VLC finding of unfitness for military service remains valid for 12 months. This provides a degree of stability for conscripts, allowing them to plan treatment and recovery. “After successful treatment, they become fit for military service and for enrollment in a military higher education institution,” adds Vladyslav Deriy.
Thus, the role of the VLC during mobilization is crucial for ensuring the health and readiness of conscripts. The commission's duty is to objectively assess citizens' health and provide necessary medical care, which in turn can affect their fitness for service.
Given these points, the importance of medical care and citizens' right to adequate treatment during mobilization becomes especially relevant. Appealing VLC decisions can significantly impact the readiness and health of conscripts, which in turn matters for the country's defense capability.
