Conflict over the flowerbed in the garden

According to The Sun: A 74-year-old widow inadvertently entered into a conflict with a neighbor who accused her of the new flowerbed 'violating their privacy.'

Jane Higgins set up the flowerbed in her front yard in East Lothian, Scotland. She happily spends time caring for the plants and flowers.

However, her family was shocked to learn that they needed to apply for a retroactive building permit for the flowerbed due to a neighbor's complaint.

“The neighbor claimed that the flowerbed infringed on their privacy, as the neighbor spends hours caring for her plants.”

They also complained that the structure “interfered with street parking” when the flowerbed was installed in April of this year and called it “an awful eyesore.”

Furthermore, the neighbor claimed that the flowerbed became “a hitch for cats using it as a toilet,” and “the cats are now fighting at night, causing excessive noise.”

Permit to keep the flowerbed

Jane's family initially thought it was a joke when they learned about the need for a permit. The flowerbed, measuring about 7 meters in length, 0.9 meters in width, and 0.8 meters in height, was built from wooden boards.

After spending several hundred pounds on architectural services and permits, a permit was obtained for the flowerbed to remain in the garden.

“The high flowerbed is noticeable from the public road to the northwest, however, it stands only about 0.8 m high and is similar in height and appearance to the fences present in the surrounding area.”

Planning officials noted that parking issues, noise from cats, and potential property damage were not grounds for planning decisions.

After receiving the permit, Jane's son, Craig Higgins, described the conflict as “absurd.”

“We were shocked by the whole situation.

“It’s just madness. My mom set up the flowerbed and never once thought she would need a permit for it.”

A permit was also granted to install surveillance cameras at Jane's home, which the neighbor also complained about.
