A Ukrainian court in Ivano-Frankivsk considered the case of a soldier who evaded service for three years but continued to receive his salary and bonuses during that time.

According to the case details, the soldier left his military unit on March 10, 2022, and did not return for three years, until April 29, 2025. Even while absent, he continued to receive his salary and additional rewards.

It turned out that the head of the radiological, chemical, and biological protection service, who also served in the same unit, supported the accused in this scheme.

'Using his official position, he did not respond to the absence of his subordinate in the military unit without proper explanations. Instead, he approved and signed the necessary documents for receiving payments - reports on monthly bonuses, bonuses, and funding for recreation.'

Part of the unlawfully obtained funds was transferred by the serviceman to the official. The total amount of damage to the state amounted to 1 million 376 thousand 75 hryvnias.

Court ruling

During the trial, the serviceman admitted his guilt. As a result of the case consideration, he was sentenced to:

  • five years imprisonment under part 4 of article 409 of the Criminal Code of Ukraine;
  • three years imprisonment under part 5 of article 27 and part 2 of article 364 of the Criminal Code of Ukraine, with deprivation of the right to hold managerial positions for three years and a fine of 17 thousand hryvnias.

According to article 75 of the Criminal Code of Ukraine, the court decided to exempt him from serving his sentence with a probation period of two years. If during this period he does not violate the law and fulfills his duties, he will not be punished according to the assigned conditions.

The Ukrainian serviceman was removed from military service for evading duties and illegally obtaining funds, avoiding the performance of his obligations for three years. By court order, he was assigned criminal liability in the form of imprisonment and fines for the committed violations.
