Recently, there has been increased activity of representatives of territorial recruitment centers and law enforcement agencies. They conduct inspections and raids in various institutions, causing concern among the population. One of the main questions that interests citizens is the legal basis for such actions. In particular, many are concerned about how legal it is for representatives of these bodies to enter private premises without the owner's permission to deliver summonses.
Ukrainians are drawn to the fact that this is possible, but only under certain conditions.
"Ukrainian legislation defines under what conditions, in particular, representatives of law enforcement agencies have the right to enter private housing. I think there will be no serious changes in this," explained the former spokesperson of the General Staff of the Armed Forces of Ukraine, Vladyslav Seleznyov.
At the same Time, he noted that notifications will continue to be conducted at checkpoints, during street checks and in public places.
Moreover, according to legislation, there are no clearly defined places where notification can be carried out.
"But there must be appropriate grounds, court sanctions for entering a residence," said the former spokesperson of the General Staff of the Armed Forces of Ukraine.
Military and criminal law attorney of the Actum law association, Oksana Dogoter, assured that mass mobilization checks near concerts, in markets and restaurants are also legal.
"Our TCC staff have the right to deliver summonses, check documents anywhere and at any time. But they must be accompanied by the police (if detention is carried out), have the appropriate permit from an authorized body to conduct inspections and deliver summonses from their leadership and also from the military-state administration," she explained.
Attorney Kateryna Anishchenko emphasized that, guided by Ukrainian legislation, TCC representatives have the right to deliver a summons to conscripts directly at their place of residence.
"This means that representatives of the military commissariat and police may have the legal right to approach the courtyard or apartment to deliver the summons," she stated.
Anishchenko also pointed out that they can enter the dwelling within the framework of procedures established by legislation to deliver official documents, including conscription summonses, but only by respecting the rights and freedoms of citizens and in accordance with the country's laws.
