How Ukrainian Critical Enterprise Leaders Can Now Cancel Employee Military Deferments.
Revoking Military Service Deferrals for Employees
According to TSN.ua: As of January 27, 2023, under Cabinet of Ministers of Ukraine Decree No. 76, managers of critically important enterprises have been granted the authority to revoke military service deferments for their eligible employees. This process is facilitated through the state's "Diia" portal, streamlining the procedure for employers. This change reflects the ongoing need to balance wartime mobilization with essential economic activity.
To initiate a deferment cancellation, an employer must submit a request, which will be processed within 24 hours. A key stipulation is that an employer can only file for such a cancellation once every five calendar days. This rule is designed to prevent potential abuse and maintain oversight over changes in employee status.
An employer has the right to initiate a deferment cancellation at their own discretion, but no more than once every five calendar days.

This underscores the importance of a considered approach to the procedure, as frequent cancellations could disrupt the workforce stability of an enterprise.
To submit a cancellation request, managers must provide the following employee details:
- Full last name, first name, and patronymic
- Identification code (RNOKPP) or passport data
- Date of birth
This information is mandatory for the request to be processed and executed.
Implications of the New Regulation
In summary, this new provision on canceling military deferrals offers enterprises a degree of flexibility in managing their personnel policies, while establishing clear boundaries for submitting requests.
The legislative amendment creates new opportunities for business leaders, allowing them to respond swiftly to labor market demands and adjust their staffing strategies amid shifting economic conditions. Simultaneously, the limits on how often deferments can be revoked aim to prevent misuse, a crucial consideration for maintaining labor market stability during Ukraine's ongoing conflict.
