Dual Citizens in Ukraine: Military Service Obligations Under New Law

Ukraine's New Dual Citizenship Law

According to Novyny.live: A new law permitting dual citizenship came into force in Ukraine on January 16, 2026. However, the specific rules regarding military service in the Armed Forces of Ukraine (AFU) for individuals holding multiple passports remain undefined. This legal gap has sparked significant concern and debate among citizens who possess citizenship in more than one country.

Expert Commentary on the Situation

Natalia Naumenko, Head of the State Migration Service, clarified the current stance, pointing to specific provisions in the law on military duty and service. She emphasized that men who have acquired Ukrainian citizenship and have already completed mandatory military service in their country of origin are not required to serve in Ukraine during peacetime. This exemption, however, does not apply during wartime or under mobilization conditions. This distinction is critical given Ukraine's ongoing defense against Russian aggression.

Oleksandr Syrskyi, Commander-in-Chief of the AFU, also commented on the matter, noting improvements in army recruitment figures.

The introduction of dual citizenship marks a significant step toward integrating the Ukrainian diaspora and improving their legal status. Yet, unresolved questions surrounding military obligations could have serious implications for national security. Further legislative clarifications and amendments may be necessary to establish clear rules for dual citizens, particularly in the context of the ongoing war.
