The issue of mobilization remains relevant for all categories of citizens, including entrepreneurs. Current legislation in Ukraine does not provide a deferral from mobilization for individual entrepreneurs based solely on their entrepreneurial status; however, some entrepreneurs may still qualify for it.

Experts from the INSEININ Law Firm explained the grounds on which individual entrepreneurs can receive a deferral from conscription.

In Ukraine, individual entrepreneurs during wartime can claim a deferral if their business meets certain criteria or if there are other grounds provided by legislation.

Who among individual entrepreneurs can arrange for a deferral?

One of the key conditions that allows individual entrepreneurs to obtain a deferral is the recognition of their business as critically important for the functioning of the economy or ensuring the vital activities of the population.

To do this, it is necessary to:

  • Confirm the status of a critically important enterprise. This may apply, for example, to enterprises operating in the defense, energy, healthcare, IT, agro-industrial complex, or other strategic sectors.
  • Submit a relevant application to the authority authorized to consider such matters (the Ministry of Economic Development of Ukraine or the relevant local authorities).
  • Provide documents that confirm the importance of the business (contracts with state or municipal enterprises, tax payment documents that indicate a significant contribution to the budget, reports on the number of jobs).

After reviewing the application, the enterprise may be included in the list of individuals subject to reservation, which effectively means a deferral from mobilization.

Other grounds for obtaining a deferral:

  • health conditions — if an individual entrepreneur has diseases that prevent military service, he or she may be exempted from conscription based on the results of the military medical commission;
  • family circumstances — a deferral is granted to individuals who have three or more children under the age of 18, are single parents, or have a child with a disability;
  • education — individual entrepreneurs who are simultaneously pursuing higher education or engaging in scientific activities may qualify for a deferral.

Moreover, if an individual entrepreneur works part-time in state bodies or institutions of strategic importance, he or she may be reserved at their primary workplace.

Earlier, we reported that individual entrepreneurs serving under contract or mobilization were exempted from tax payments and reporting for the duration of their service. The relevant changes in tax legislation have already come into effect.

Ukrainian entrepreneurs can receive a deferral from mobilization if their business is recognized as critically important for the economy or if they fall under other categories provided by law. This allows for the support of enterprise functioning and ensures business stability in wartime conditions.
