Under Article 10 of Law No. 504/96-VR 'On Leave,' adhering to this schedule is not optional—it is a legal requirement. While employers can now initiate leave without a written application from the employee, they are still obligated to provide at least two weeks' written notice before the leave begins. Payment for the vacation period must be made no later than the day before the leave starts, a rule designed to prevent financial strain on workers.

It's worth noting that refusing to take scheduled leave could be considered a breach of work discipline, as outlined in Article 139 of the Labour Code. Additionally, if an employee goes two consecutive years without taking any vacation, that itself constitutes a violation of the law.
