Another category of conscripts will receive deferment from mobilization: Ministry of Defense supported the project.
The Ministry of Defense of Ukraine supported bill 11391, which concerns deferment from conscription for men whose brother or sister died during the war.
According to the "Judicial-Legal Newspaper," the mobilization law previously exempted people from conscription whose relatives died or went missing during hostilities. This applied to spouses, children, parents, grandparents, as well as brothers and sisters.
However, the law was later changed to exclude half-siblings from the list. As a result, in April, a petition was submitted to the President's Office requesting a review of this change as it allowed for the conscription of a second son if his half-brother died.
Thus, an amendment was made to the mobilization law, removing the ban on mobilizing the brother of the deceased if he was not a full sibling.
Legislators note that brothers born and raised by the same mother may not be related to each other and the mother must send her second son to war if the first died, but from another man.
In this regard, bill 11391 was registered in the Verkhovna Rada, which proposes to correct this provision. The bill provides for amendments to the Law of Ukraine "On Mobilization Training and Mobilization", specifically to the third, fourth, and fifth points of part three of Article 23. Thus, a deferment from conscription for military service will be provided for conscripts whose brother or sister, whether full or half-siblings, died or went missing during hostilities.
Member of the Verkhovna Rada Committee on National Security Alexander Fediyenko reported that the committee will soon consider this bill. The Ministry of Defense also supports this bill based on its conclusion.
