Challenging the Fines

Legal proceedings to contest a fine can take several months. A court has the authority to cancel a fine if certain grounds are present, including:

  • Issues with the formal delivery of a military summons;
  • Procedural errors in the case;
  • Insufficient evidence;
  • The expiration of the statute of limitations for imposing the penalty.

For instance, problems with summons delivery may involve a missing personal signature or lack of confirmation from Ukrposhta, the national postal service. Procedural mistakes can include improper notification about the date, time, and location of a hearing. Weak evidence might be a summons listed in an electronic register but never physically delivered. A court may also overturn a fine if the decision was made after the legal deadline for liability had passed.

It is important to note that simply filing an appeal does not automatically halt the collection process. To avoid having their bank cards blocked, legal experts advise individuals to either file an additional motion to suspend enforcement or to pay the fine first and seek reimbursement through a separate lawsuit if they win their case. As lawyer Yurii Kosteniuk noted:

“This approach helps prevent negative consequences for an individual's financial affairs.”

Therefore, individuals liable for military service who receive TCC fines must pay close attention to appeal deadlines and the specific conditions under which a fine can be overturned. Given the constraints of martial law and mobilization, understanding one's legal rights and procedural options is crucial.
