Court Rules Against Recruitment Center Inaction

According to Novyny.live: A court in Ivano-Frankivsk has ruled that a Territorial Recruitment Center (TRC) acted unlawfully by failing to act. The court has ordered the center to officially register a man's medical ineligibility for military service after he was removed from the military register in 2024. This ruling is part of an ongoing effort to ensure administrative bodies comply with legal obligations regarding military conscription. According to the court's decision, the ineligibility status must be recorded with an effective date matching the issuance of his medical certificate.

The man in question was removed from the military register in late 2024. He had undergone a military medical commission in November 2024 and received a certificate confirming his unfitness for service on November 26 of that year. In February 2025, after the TRC failed to update the registry with this information, the man formally requested the center to enter the relevant data.

Significance of the Legal Ruling

Upon reviewing the case, the court mandated the TRC to register the service ineligibility, backdated to when the medical certificate was issued. The court also ordered the TRC to pay a court fee of 968 hryvnias and 96 kopiyok to the plaintiff. This decision sets a significant legal precedent for other individuals who may encounter similar bureaucratic delays in the future.

This case underscores the critical importance of adherence to military registration laws and the rights of citizens who have legitimate medical grounds for exemption from service.

The court's ruling could lead to changes in how Territorial Recruitment Centers operate and increase public awareness of citizens' rights in comparable situations.
