Warrior's widow sued the Ministry of Defense for the non-payment of 15 million UAH - verdict.
The Ministry of Defense of Ukraine refused to provide financial assistance of 15 million UAH to the wife of a soldier who died while performing his duties. To challenge the ministry's decision, the woman turned to the court.
This is stated in the verdict issued by the Lviv District Administrative Court on July 10.
According to court documents, a driver of a rifle platoon from one of the military units died in 2022 while performing his duties in the Bakhmut district of Donetsk region. Initially, the cause of the soldier’s death was attributed to careless handling of weapons, leading to an accident, but the Central Military Medical Commission of the Armed Forces of Ukraine refuted these rumors, stating that the soldier died while performing military duties.
In November of last year, the widow of the soldier contacted the Ministry of Defense to receive a one-time assistance of 15 thousand UAH, but she was refused, with an explanation that the payment is not provided if the military died as a result of an administrative violation.
Court's Decision
After examining the case materials, the judge concluded that the widow of the fallen soldier has the right to financial assistance. The protocol of the Ministry of Defense's commission denying the appointment of the payment was canceled - the Ministry of Defense must reconsider her application for the financial assistance.
The court's decision can be appealed within 30 days from the day of its announcement by filing an appeal.
It is worth noting that the military, during a conversation in a chat with friends, wrote about the location of the military equipment of the Armed Forces of Ukraine. The man was sentenced to imprisonment, but he had already served most of his sentence, having spent two years in pre-trial detention.
We also reported that in Odesa region, a conscript was giving his salary to his commander while avoiding service. He was punished with official restrictions and a monthly deduction of 10% of his salary.
The Ministry of Defense of Ukraine decided to refuse the widow of the deceased soldier financial assistance, but the decision was canceled by the court. The court ruled that the widow has the right to financial support and obliged the Ministry of Defense to reconsider her application for the payment. This verdict can be appealed within 30 days.
