Educational Workers' Right to Deferment from Mobilization
According to Novyny.live: Once an employee leaves their position at an educational institution, they forfeit their eligibility for a mobilization deferment. However, during an inspection, a notification team from the Territorial Recruitment Centers (TCC) may still recognize this deferment as valid. This issue has gained urgency due to widespread concerns among education staff about their mobilization status following resignation.
For educators, the deferment from mobilization remains in effect only as long as they are actively employed by a school or university. Specifically, teaching staff working at least 0.75 of a full-time position qualify for this benefit. Yet, upon leaving their job, the deferment is automatically canceled. Vladyslav Deriy, a TCC representative, stated:
“No, the deferment is no longer valid.”This confirms that resigning from a teaching role immediately revokes the individual’s right to deferment.
Possibility of Using Deferment After Resignation
There is interest in whether a deferment can still be used even after an employee has quit. If the deferment remains visible in the electronic system 'Reserve+', the individual may still be able to apply it. However, it is important to note that the process of canceling a deferment after leaving a college or school can take up to three weeks. This delay creates uncertainty for those awaiting mobilization decisions.
In summary, TCC representatives will not hold former employees accountable if their deferment is deemed valid during a check. Nevertheless, educators cannot count on retaining their deferment after losing their position, highlighting the need for a careful assessment of legal aspects surrounding mobilization for education workers.
This situation underscores the importance of keeping education staff informed about their rights and obligations under mobilization rules. During wartime, when mobilization issues become especially critical, school and university employees must stay updated on legislative changes and the potential risks tied to resignation. At the same time, authorities should ensure transparency and clarity in mobilization-related matters to prevent unnecessary anxiety among citizens.
