What You Can Build on Your Land Without a Permit: A Guide to Temporary Structures.
New Freedoms for Landowners
According to Novyny.live: A recent government decree, Cabinet Resolution No. 406, has simplified regulations for landowners in Ukraine. It now permits the construction of certain temporary structures without the need to obtain formal building permits, offering new flexibility for property development while still mandating adherence to specific planning rules.
Defining Temporary Structures
The following types of temporary structures can be erected without permits:
- Gazebos
- Pavilions
- Canopies and awnings
- Tents
- Garden furniture installations
- Greenhouses
- Outdoor showers
- Toilets
- Wells
A structure is considered temporary if it can be disassembled and relocated without being destroyed. However, even for these projects, compliance with land use regulations is mandatory. This regulatory change is part of broader efforts to reduce bureaucratic hurdles for small-scale property improvements.
Under Ukraine's Law 'On Regulation of Urban Development Activities,' any development must still follow a building passport or a formal notification of work commencement. Specific rules also apply: outbuildings must be placed at least 1 meter from the property boundary. Furthermore, canopies or roofs must be designed so that rainwater does not drain onto a neighboring plot, a key consideration for maintaining good relations.
It is crucial to note that using or encroaching upon any part of a neighbor's land without their consent or proper legal authorization is strictly prohibited. As expert Oleh Kozliak emphasized:
“Adherence to these norms is the foundation of peaceful neighborly relations.”
All construction must also comply with state building codes, ensuring safety and comfort for everyone in the community.
In summary, while Cabinet Resolution No. 406 streamlines the process for building temporary structures, it is vital to remember the accompanying responsibilities and rules. Following them is essential to avoid misunderstandings and conflicts with neighbors.
This development is significant for landowners, enabling them to develop their properties more quickly and with less red tape. Conversely, it could lead to an increase in neighborly disputes if the stipulated rules are ignored. Landowners must understand that simplified procedures do not eliminate the responsibility to comply with development norms. Therefore, all parties involved should be fully aware of their rights and obligations to ensure harmonious coexistence within their communities.
