According to ТСН: In Ukraine, general mobilization is ongoing, during which strategically important enterprises can reserve their employees. However, sometimes to extend the deferral from military service, men are required to undergo a military-medical commission (MMC).

Human rights defenders reported that a Ukrainian approached them with a question about the necessity of undergoing a medical commission to extend his reservation, which was insisted upon at his workplace.

Explanation from the Lawyer

Lawyer Yurii Aivazian explained that the procedure for extending the reservation does not imply mandatory medical examination.

“Undergoing an MMC is only mandatory if you receive a summons or referral for a medical examination from the Territorial Center for Recruitment,” the lawyer emphasized.

Thus, the military reservist does not have to independently initiate a visit to the doctors without a call from the territorial recruitment center.

The lawyer added that the reservation procedure can be complicated if the data of the military reservist is not updated or there are accounting issues.

“The main thing is that you are not wanted by the Territorial Center for Recruitment,” noted Aivazian.

Difference Between Theory and Practice

Viacheslav Kyrda, another human rights defender, emphasized that the actual process may differ from the theoretical one due to the position of a specific enterprise. Although legally a conclusion from the MMC is not mandatory for submitting documents for reservation, the employer may choose to take precautionary measures.

“Legally, you do not need to undergo an MMC, but it all depends on the employer's position who will be submitting your reservation,” explained the lawyer.

Even if the military reservist has to undergo an MMC (for example, due to receiving a summons for data clarification), the results of the commission cannot be a reason for refusal in reservation if all other documents are properly completed. This is merely an update of military registration data, carried out parallel to the deferral issuance.

Other Aspects of Military Registration

It was previously reported that ignoring summons or violating military registration does not entail automatic confiscation of vehicles under the law. It is known that the Territorial Center for Recruitment does not have the right to seize vehicles or driver's licenses; only a court can impose a temporary restriction on driving privileges.

Vehicle confiscation is only possible within the frameworks of criminal proceedings where such a measure is directly provided for by law, and violations of mobilization rules do not fall under this.

Therefore, citizens subject to military registration should be cautious and seek consultations from specialists to avoid misunderstandings. As seen, the process of military registration and reservation is connected with many nuances, so paying special attention to details can protect against potential problems.
