Details of the case

According to the case materials, the accused is a native of Kharkiv, is married, has a minor child to support, and works at the LLC 'Industrial Service'.

In January 2023, at the bus station in Poltava, he sold a car for 4,450 dollars. This vehicle was imported from abroad as humanitarian aid for the Armed Forces of Ukraine. In February of the same year, he sold two more cars, imported by one of the charitable organizations, for 14,900 dollars. Thus, the man earned 707 thousand hryvnias from the sales.

During the court hearing, the accused refused to testify, explaining that he was engaged in volunteering and helping the military. According to him, the cars were bought abroad with money, so they are not humanitarian aid. He also claimed that he spent his own funds on purchasing the cars, and part of the profit, amounting to 100–200 dollars, was used to cover expenses for volunteer activities.

One of the witnesses in the case stated that he was looking for a car for acquaintances from the Poltava territorial defense and found an advertisement on OLX marked 'Cars for the Armed Forces'. After inspecting the car, he was not satisfied with its condition and price, to which the seller replied that he could find a car in better condition. The situation seemed suspicious to the man, and he reported it to the Security Service of Ukraine.

Court's decision

The Kyiv district court of Poltava found the man guilty of committing a criminal offense under part 3 of Article 201-2 of the Criminal Code of Ukraine — illegal use of humanitarian aid, charitable donations, or gratuitous assistance with the aim of obtaining profit.

The court sentenced him to 5 years in prison with confiscation of all his property. He was also prohibited for three years from engaging in activities related to the circulation, use, or disposal of humanitarian aid.
