Some Men with Disabilities to be Sent to VLC in August: Reason.
Ukrainians were explained whether participants with disabilities need to undergo a medical-military commission (VLC).
According to lawyers Kateryna Anishchenko and Roman Simutin, who specialize in mobilization issues, since the updated mobilization law came into force, a discussion has arisen regarding the necessity of a repeated medical examination for Ukrainians with disabilities. This concerns both individuals who had disabilities before the invasion began and those who acquired them after February 24, 2022. This issue has generated increased interest on social media, where users turn to specialists for clarifications.
Representatives of one of Kyiv's territorial recruitment centers (TRC) responded that the possession of a disability certificate grants the right to deferral, so persons with disabilities (acquired after February 24, 2022) do not need to undergo VLC.
Lawyer Kateryna Anishchenko explained that the military-medical commission (VLC) and the medical-social examination commission (MSEC) are two different commissions. The MSEC assigns the disability group, whereas the VLC does not have the authority to determine a person’s ability to work. According to her, individuals with a disability group (2 or 3) do not need to undergo VLC according to the Cabinet of Ministers' decree. However, if a conscript does not have a military ID but has a disability, he is sent to VLC to obtain a military ID.
Lawyer Roman Simutin noted that even participants with disabilities acquired after February 24, 2022, are not obligated to undergo VLC. He reminded that those previously recognized as limited-fit should undergo it by February 2025. And individuals with a disability group have the right to deferral and do not need to undergo VLC. He also emphasized that VLC and MSEC have different criteria. In the case of disability, a person is subject to mobilization only with their own consent.
It is worth mentioning that the recruitment centers ignore documents in “Reserve+”.
