How Ukrainian Businesses Can Reclaim Wrongfully Mobilized Employees.
Protecting Key Workers: A New Path for Demobilization in Ukraine
According to TSN.ua: In Ukraine, there are ongoing instances of men with legitimate deferrals or official exemptions from military service being mobilized. This is causing significant concern, particularly within the agricultural sector, where essential workers with such protections can be mistakenly called up. Yaroslav Kuts, a member of the parliamentary committee on information policy, has outlined the options available for businesses to get these employees back to work.
The Process for Reclaiming Employees
A mechanism has been in place since December 2025 that allows companies to seek the return of employees who were mobilized in error. Yaroslav Kuts noted that:
'Even if an individual's exemption was revoked or they committed a violation in their military registration, there is still a possibility for the company to submit all necessary documents for demobilization.' Yaroslav Kuts, Member of the Committee on Information Policy
This represents a crucial step for preserving the workforce in vital sectors like agriculture. Kuts emphasized he has repeatedly encountered such situations in the agro-sector, highlighting the problem's prevalence. If a mobilization occurs, the enterprise can file for demobilization while the individual is undergoing basic training. This provides companies with a tool to actively respond to legislative changes and protect their staff. The agricultural sector is a cornerstone of Ukraine's economy, making the retention of skilled labor a national priority.
The wrongful mobilization of exempted employees has serious consequences for Ukraine's agro-sector, which is already grappling with a labor shortage. With these new demobilization mechanisms, businesses now have a formal avenue to shield their workers, which could help maintain stability in the industry.
The urgency of this issue underscores the need for businesses to continuously monitor legislative updates and their impact on Ukraine's labor market.
