Conscripts have the right not to go to the Military Medical Commission: who can avoid the medical examination

In the conditions of mobilization and martial law, the fitness or unfitness of conscripts for service is determined by the Military Medical Commission. However, under certain circumstances, being directed for a medical examination is illegal.

As stated by lawyer Daria Tarasenko.

Who can be summoned to the Military Medical Commission

According to current legislation, in the conditions of martial law, conscripts must update their health status data once a year.

Special rules for passing the Military Medical Commission apply to those who:

  • have never undergone a medical examination or have done so more than a year ago;
  • have undergone the Military Medical Commission less than a year ago but have health complaints;
  • have submitted a request for deferment, but it has not yet been considered;
  • are fit for limited service but do not have a disability;
  • were previously temporarily unfit, but currently no longer have that status, as the term of temporary unfitness has expired.

Who has the right to undergo a medical examination solely at their own request:

  • people with disabilities;
  • those who have undergone a medical examination less than a year ago and have no health complaints;
  • conscripts who have a valid deferment and are not considered limited fit under the new procedure;
  • those who have submitted a request for deferment, are not limited fit, and have not undergone the Military Medical Commission under the new procedure.

The total duration of passing the Military Medical Commission is no more than four days. Additional examinations may be allocated up to 14 days.
