According to Novyny.live: In a landmark ruling, the Chernihiv District Administrative Court has declared the actions of the local Territorial Center for Recruitment and Social Support (known as the TCC) unlawful after it forcibly drafted a citizen of Azerbaijan into the Armed Forces of Ukraine. The court overturned the mobilization order, emphasizing that foreign nationals are not constitutionally obligated to defend Ukraine. This case highlights a critical issue for the many foreigners residing in Ukraine, whose legal status and responsibilities during wartime are not always clearly defined.
The Incident and Court Decision
The forced conscription of the Azerbaijani man occurred on March 12, 2026. The individual, who legally resides in Ukraine with a permanent residence permit, was ordered to report for military service that same day when the head of the enlistment office signed the mobilization directive. After reviewing the case, the court annulled the TCC’s order, ruling that the conscription was unlawful.
On May 26, 2026, the foreigner was voluntarily released from military service and placed in the reserves. The court further mandated that the TCC reimburse the plaintiff 665.60 Ukrainian hryvnias in court fees. This decision sets an important precedent regarding the rights of foreign nationals living in Ukraine and their obligations in the context of mobilization.
The case underscores the necessity of adhering to legal frameworks during the conscription process and protecting the rights of foreigners in Ukraine.
