Ukrainians were explained how to challenge the decision of the military medical commission: instructions for conscripts.
Persons with the category 'limited fit' were given explanations regarding the possibility of appealing the decision of the military medical commission. The press service of the Ministry of Justice emphasized that by June 5, they will have to undergo a repeated medical examination at the military medical commission, after which they will receive a final conclusion regarding their fitness for military service.
If a person is dissatisfied with the decision of the medical commission, they can submit a written complaint to the higher-level military medical commission. This instance may reject the complaint or appoint an additional medical examination for a final determination of fitness. There is also the possibility of appealing to an administrative court as an alternative way to challenge the decision of the military medical commission, in accordance with Ukrainian legislation. The time frames for court appeals are 3 months after receiving a response from the higher military medical commission or 6 months from the moment of receiving the conclusion from the military medical commission.
These important legal aspects will help Ukrainians safeguard their rights and make the right choice in similar situations.
In case of disagreement with the decision of the military medical commission, a person can exercise their right to judicial protection through the administrative court or seek assistance from the higher-level military medical commission. These measures can help safeguard the rights of citizens and resolve issues of fitness for military service.Read also
