Two Poles who married in Germany approached the court, but they were denied the issuance of a transcript of their marriage certificate in Poland, where same-sex marriages are not allowed.

“This refusal contradicts European law as it creates an obstacle for the freedom of the respective citizens to move from one country to another, while enjoying their acquired rights within the Union. It undermines this freedom as well as the right to respect for private and family life,” said the EU Court.

Thus, member states must recognize family status legally acquired in other countries. However, it is worth noting that Poland is not obliged to introduce same-sex marriages in its national legislation.

Earlier in Ukraine, the question of legalizing partnerships for same-sex couples was discussed. President Volodymyr Zelensky noted that according to the Constitution of Ukraine, marriage is based on the free consent of a woman and a man (Article 51). Under conditions of martial or emergency state, it is impossible to change the Constitution (Article 157 of the Constitution of Ukraine).

“Therefore, I appealed to the Cabinet of Ministers of Ukraine with a proposal to work on the issue of introducing the institute of registered civil partnership,” the president wrote.

The situation with the recognition of same-sex marriages in the EU and Ukraine underscores the relevance and complexity of human rights issues in different countries. The EU Court's decision may influence the further policy of member states regarding the rights of the LGBT community, while in Ukraine, the issue will likely remain contentious in light of existing legal restrictions.
