From what age can you work.
The work process in Ukraine is fully regulated by law, although unofficial employment can often be found. However, it is the law that determines at what age one can work (referring to schoolchildren and students, first and foremost).
It is not possible to determine at what age one can work on one's own, even if it concerns a contract with a private company. Special attention should be paid to part-Time work and a reduced working day (this partially affects the age at which one can be employed).
When and from what age can you start working?
In Ukraine, the legislation establishes the minimum age for employment and special conditions for the labor of minors. That is, the general question of how many years old one can start working is from 18. This is the minimum age. But there are some exceptions. In many cases, you can start working from the age of 16. That is, you can start working in school, but with certain conditions. Norms for 14 and 15 years old are also permissible and can be employed at the legislative level.
The main provisions of such exceptions are:
-
Minimum age for employment. 16 years old: as a general rule, the minimum age for employment is 16 years old. Work from 15 years old: with the consent of one of the parents or a person who replaces them, individuals who have reached 15 years old may be employed (Article 188 of the Labor Code).
-
Work from 14 years old. For students studying in general education schools, vocational-technical, and secondary specialized educational institutions, performing light work that does not harm their health and does not interfere with the learning process is allowed with the consent of one of the parents or a person who replaces them.
Features of the labor of minors:
-
Reduced working hours. The working hours for employees aged 16 to 18 should not exceed 36 hours per week, and for persons aged 15 to 16 and students aged 14 to 15 working during the academic year in free from studying time should not exceed 24 hours per week.
-
Prohibition of heavy and dangerous work. It is also prohibited to involve minors in performing heavy work, work in harmful or dangerous conditions, as well as underground work (Article 190 of the Labor Code).
-
Medical examinations. Minor employees must undergo mandatory preliminary (when starting work) and periodic (annual) medical examinations. This provision has its own peculiarities.
-
Minor employees are entitled to an annual basic leave of 31 calendar days, which is granted at a convenient time for them.
In addition, the employer is obliged to ensure compliance with the labor rights of minors and provide them with the necessary working conditions that correspond to their age and physical development.
In general, Ukrainian labor legislation provides opportunities for employing adolescents from the age of 14, but with special conditions and limitations aimed at protecting their health and ensuring normal development. The main age for starting work is 16, but with the consent of the parents, one can start working at 15. Employers are strictly required to comply with all norms related to the work of minors to ensure their rights and safety.
Age labor restrictions in Ukrainian legislation
Ukrainian legislation establishes age restrictions for starting work and provides certain rights and privileges after ending work. The main provisions concern the minimum age for starting work, special conditions for the work of minors, and retirement age.
Such provisions are important for both the beginning and ending of work. Restrictions apply to all citizens of Ukraine.
Start of work:
-
Minimum age for employment. The main age to start work without any additional conditions is 16 years old. With the consent of one of the parents or a person who replaces them, employment is allowed from the age of 15. From the age of 14, students of general education schools, vocational-technical, and secondary specialized educational institutions may perform light work in their free time from studying with the consent of one of the parents or a person who replaces them.
The end of work is also determined by Ukrainian legislation. What are the conditions in this case:
-
Retirement age. In Ukraine, age criteria for retirement are established depending on gender and age of the individual, which are regulated by the Law of Ukraine "On Compulsory State Pension Insurance." The retirement age depends on the gender and age of the individual.
-
For women in 2021, the retirement age for women is 60 years.
-
For men, the retirement age for men is 60 years.
-
The retirement age may be reduced for persons working under particularly harmful or difficult working conditions and for some other categories of workers specified by the legislation.
Ukrainian legislation does not establish a mandatory age for ending work. Pensioners may continue working at their own discretion. Working pensioners have the right to receive wages and pensions simultaneously.
In summary, in Ukraine, the minimum age to start working is 16, with the possibility of working from the age of 15 or 14 under certain conditions. The end of work officially occurs upon reaching the retirement age, which is 60 years for men and women. However, the legislation does not limit the continuation of work after reaching the retirement age, providing the possibility to work further at one's own discretion. All these provisions may have their corrections, for example, during a war.
