Land Rights for Military Personnel in Ukraine
According to Novyny.live: Ukrainian law grants land rights to military personnel, but the process of allocating plots to combat veterans has been suspended due to Russia's full-scale invasion. The operation of the State Land Cadastre is considered halted, which complicates the transfer of land into private ownership. Under current regulations, the right to land for service members has not been revoked, and the law provides for the priority allocation of plots to those who have participated in hostilities.
Because of the war, a ban is in effect on transferring land and issuing permits for land-use planning documentation. This means it is currently impossible for a combat veteran to receive a land plot. As expert Alyona Chmona noted,
"right now, it is impossible for a combat participant to receive a land plot."
The Procedure for Obtaining Land
According to current legislation, the allocation of land for personal farming can be up to 2 hectares, and for rural construction, up to 0.25 hectares. However, due to the present circumstances, these opportunities remain inaccessible to military personnel. The procedure for obtaining land for service members was designed to be a priority and required submitting a series of documents, including:
- an application for a permit;
- a copy of a passport;
- a document confirming status and benefits;
- graphic materials.
For obtaining plots for farming, documents confirming agricultural education or experience may be required.
Thus, against the backdrop of military action and the suspended land cadastre, service members are left unable to realize their right to land, which calls into question their social support and housing provision. This situation highlights a significant gap between legal promises and practical reality for those defending the country.
The situation regarding land allocation for Ukraine's military personnel points to serious challenges faced by combat veterans in the context of war. The suspension of the land cadastre and the ban on land transfers could negatively impact social stability and the well-being of soldiers in need of support. It is important to monitor further legislative changes and potential solutions that could ease access to land plots for this category of citizens.
