Ukrainians have been clarified which years do not count towards the insurance record for retirement.
As reported by 'Hvylya', this was stated by lawyer of the 'Ivan Khomych' law firm Olena Voronkova in a comment to UNIAN.
In Ukraine, pension provision depends on the salary and the insurance record of a person. The longer the insurance record and the higher the salary, the larger the pension a citizen may receive.
Until 2004, Ukraine had a system of labor records that were recorded in the employment book. However, starting in 2004, an insurance record system was introduced.
The insurance record only accounts for periods of work for which contributions were paid to the Pension Fund of Ukraine (PFU).
According to the lawyer, although insurance contributions to the PFU were introduced as early as July 1, 2000, their payment was not mandatory at the beginning. Contributions became mandatory on January 1, 2004, when the law 'On Mandatory State Pension Insurance' was adopted. From that moment, to count the period of work towards the insurance record, it is necessary to pay contributions to the Pension Fund.
'It is better for a person if from July 1, 2000, to January 1, 2004, insurance contributions were already paid for them, which can be confirmed by certificate form OK-5, and they can prove this to the Pension Fund. But if a person has an entry in the employment book, and at the same Time no insurance contributions were paid during that period, in most cases, it is possible to achieve the inclusion of such experience in calculating the pension through the court,' Voronkova explained.
The lawyer emphasizes an important point: starting from 2004, even if there is an official entry in the employment book, if an unscrupulous employer did not pay insurance contributions, this period will not be counted by the Pension Fund towards the insurance record. In such cases, a citizen has the right to go to court to try to have this period counted towards their record.
It is noted that for those who worked officially before 2004 and after, the actual labor and insurance records are summed up for retirement.
Periods of official employment are included in the insurance record, including the time spent on vacation and sick leave.
Regarding the period of study, study in technical schools, colleges, and higher educational institutions before 2004 counts towards the labor record, which, as mentioned earlier, is also taken into account when calculating the pension.
As for maternity leave, in Ukraine, the time spent on maternity leave up to three years is counted towards the insurance record.
However, the following do not count towards the insurance record:
- work before 2004, for which there is no information in the employment book - such experience can be counted based on clarifying certificates, reconciliation acts, or through a commission;
- the time when a person worked without official registration, i.e., did not pay contributions to the PFU;
- the time spent studying in colleges, technical schools, and higher educational institutions after 2004.
The lawyer also emphasizes that until 2016, periods when a person worked under a civil law contract were not counted, as no contributions were paid for employees at that time.
It is reminded that in Ukraine, salaries will be increased for another category of citizens.
