How does the algorithm for the voluntary return of military personnel to service work? Explanation by DBR.
Military personnel who have left military units or places of service without permission have the opportunity to voluntarily return to service until January 1, 2025. This was reported by DBR communication adviser Tetyana Sapyian during the telethon 'Unity News'. She noted that this law was adopted to provide military personnel with the opportunity to return to their units and continue their service without any legal issues in Ukraine.
The main goal of the law is to create opportunities for military personnel who went AWOL to return to military units by January 1, 2025, and continue their service without guilt and without conflict with Ukrainian legislation.
The advisor also reminded that a special algorithm has been established for the return of military personnel to service. According to the law, military personnel who have deserted or left military units without permission before this law came into force may voluntarily return to their units until January 1, 2025.
The commander of the military unit to which the serviceman returned continues the action of his contract no later than 72 hours after arrival. In addition, all social benefits provided by the state for such military personnel are restored.
The commander is also obliged to inform the pre-trial investigation authorities and the military service about the continuation of the serviceman's contract. This guarantees the automatic closure of criminal prosecution that has been initiated against the serviceman.
If the serviceman does not return to the place of service before January 1, criminal proceedings may result in a verdict. According to Tetyana Sapyian, military units will gladly welcome their brothers back to service.
Story about a desertion case
The message also mentioned an individual who promoted desertion and called on other military personnel to flee. He was suspected of desertion. This individual was detained by DBR and SBU employees. According to the Criminal Code of Ukraine, desertion can result in imprisonment for up to 10 years.
It is known that deserters from the military are a serious problem for the Armed Forces of Ukraine. According to unofficial data, their number is at least 100,000 individuals.
It was also noted that the court extended the preventive measure for one of the military personnel who left the unit without permission. He will remain in custody until January 15.
