A second group disabled person fined for failing to attend the Military Registration and Enlistment Office: the court canceled the decision
A man from the Ternopil region, who has a second group disability, was fined for failing to appear at the military enlistment office, although he was not sent a summons. To contest this decision, the man went to court. The decision was made by the Kremenets District Court of Ternopil region on August 5.

This is quite an unusual resolution: the man was fined for critical absence from the military enlistment office, even though he did not receive a summons! Interestingly, it was the citizen who decided to defend his rights in court, rather than simply pay the fine.

Case details

The defendant learned from the executive service about a debt of 17 thousand hryvnias. He was fined for failing to appear at the Military Registration and Enlistment Office and the Public Security Department. The man did not agree, as he did not receive a summons, and due to disability, he was not required to appear. A representative of the Military Registration and Enlistment Office explained that he sent the summons for the medical examination by mail, but the man's lawyer disputed the existence of proof of sending the document.

Court decision

The court ruled that on March 11, the claimant did not appear at the Military Registration and Enlistment Office and the Public Security Department due to the absence of a summons. The ruling was canceled, and the case was closed. The decision will come into force in 30 days. It can be appealed by filing an appeal.

A notification about the fine to a man who did not receive a summons to the military registration office due to his disability was canceled, accepting his arguments in court. Everyone has the right to defend their rights and uphold their position before the law.
