Legal Expert Clarifies When Draft Offices Can Detain Citizens.
Rights of Individuals Liable for Military Service
According to Novyny.live: During a meeting with citizens liable for military service, lawyer Yuriy Aivazyan clarified the legal grounds for detention. He stated that a notification group from a Territorial Recruitment Center (TRC) is only authorized to detain an individual if that person is officially listed as a fugitive. If no violations are found and the individual is not being sought, they have no right to detain them. This guidance came in response to a citizen's inquiry about their rights during an interaction with a notification group.
Aivazyan emphasized the importance of individuals knowing and defending their specific rights.
"If no violations are found, and you are not considered a fugitive, then no one has the right to detain you," stated Yuriy Aivazyan.Understanding these rights is crucial in Ukraine, where legal procedures surrounding mobilization are strictly defined.
Attorney's Recommendations
Furthermore, Aivazyan advises against agreeing to military personnel's suggestions to visit a TRC without clear necessity.
"Do not agree to any proposals from the military like 'let's go to the TRC and see.' Instead, call the police immediately," recommended Yuriy Aivazyan. This advice can be vital for those who find themselves in situations requiring the protection of their legal rights.
The information underscores the critical need for legal awareness among those liable for service, particularly when issues of conscription and detention can cause significant stress. Being informed can help prevent unlawful actions by representatives of military structures. Heeding such legal counsel is a crucial step for citizens navigating complex circumstances.
