According to his statement, businesses must first obtain the status of a critically important enterprise to qualify for this reservation privilege.

The mandatory requirements for securing this designation include:
- An average salary level of at least 26,000 hryvnias;
- No outstanding tax debts;
- A third criterion that companies can select on their own.

The standards for earning critically important status are defined by a Cabinet of Ministers resolution. For the third criterion, one option is paying over 1.5 million hryvnias in taxes annually, or achieving an annual foreign currency revenue exceeding 32 million euros.
