Ukrainian MP Venislavskyi Clarifies: No Forced Conscription of Foreign Residents
According to Novyny.live: Fedor Venislavskyi, a member of the Ukrainian parliament's Committee on National Security, Defense, and Intelligence, has confirmed that the forced mobilization of foreign residents in Ukraine is impossible. This is due to its direct conflict with the country's Constitution. While Ukraine remains at war, the question of compelling foreigners with residency permits to serve has not been considered.
According to Venislavskyi, initiatives for such a mobilization have not been discussed at the committee level. Ukraine is home to approximately 100,000 foreign nationals with residency permits. The constitutional duty to defend the state does not extend to non-citizens, a legal principle that remains in force despite the ongoing conflict.
'First of all, such initiatives have definitely not been considered at the level of the Committee on National Security, Defense, and Intelligence,' stated Fedor Venislavskyi.
For any legal grounds to conscript non-citizens to be created, amendments would be required to Ukraine's Law 'On Mobilization Training and Mobilization.' Venislavskyi emphasized that the only current format for foreign military service in Ukraine is strictly voluntary. This legal framework underscores Ukraine's commitment to its constitutional order even during wartime.
'The only mechanism for foreigners to perform military service that exists today is service in the foreign military legion, which is carried out exclusively on a voluntary basis by signing a contract,' clarified Fedor Venislavskyi.
Therefore, the issue of forcibly mobilizing foreigners in Ukraine remains closed. All efforts to involve them in military service occur solely on a voluntary basis. This situation highlights the importance of upholding constitutional norms during a military conflict and reflects Ukraine's strategy for engaging foreigners in its defense efforts.
While foreigners have the opportunity to serve in the Armed Forces of Ukraine, it is only through voluntary contracts. This policy may influence the number of international participants in Ukraine's military formations. As the war continues, the topic of recruiting foreign volunteers will remain relevant, but the legal boundaries are firmly and clearly defined by existing legislation.
