According to ТСН: In Ukraine, general mobilization is underway during the state of war. Men eligible for military service aged 25 to 60 are called to enlist, but some categories have the right to deferment or reservation. This includes fathers of three or more children, although under certain conditions, these men can also be mobilized.

Deferment for fathers of many children: How to apply for it

A father of many children can apply for deferment from mobilization through the application “Reserv+” or contact the administrative services center (ZADP). He must submit an application and a package of documents that prove the right to deferment.

Lawyer Marina Bekalo noted that one of the key requirements for obtaining deferment is the absence of arrears in alimony payments for more than three months.

Which documents are needed to apply for deferment

To obtain deferment, the conscript must present his passport, a military document, and the birth certificates of the children in which he is registered as the father, along with a marriage certificate or a court ruling on divorce.

Additionally, information from the debtor registry must be provided to confirm the absence of alimony arrears.

If the children are not biologically related to the conscript, he must present documents confirming his guardianship of the children. These could be court decisions or other confirming documents.

Thus, a duly issued deferment excludes the father of many children from mobilization.

In which cases can the father of many children be mobilized

At the same time, Marina Bekalo warns: If the conscript has not submitted an application for deferment along with the confirming documents, he can be mobilized.

The lawyer emphasizes that if the man shows up at the territorial recruitment and social support center (TRSZ and SUS), he should immediately assert his right to deferment and present the appropriate documents in case of forced mobilization.

Can fathers of many children travel abroad?

A father of many children has the right to leave Ukraine during the state of war. As the lawyer explains, he can cross the border both with and without the physical presence of the children.

For this, he must present a military document from the “Reserv+” application at the border crossing, which has no information about being summoned and notes the approved deferment. Additionally, the birth certificates of the children - in original or certified copies - must be presented.

A father of many children was sentenced for evading mobilization in Western Ukraine

Remember that a court in Western Ukraine sentenced a father of three children who was found guilty of evading mobilization. The man received the call-up but did not appear at the territorial recruitment and social support center, for which he was held criminally liable.

According to the ruling of the Zhydachiv District Court in Lviv Oblast, the man had three minor children to support. In May 2023, he received the call-up, passed the medical examination, and was declared fit for military service, but did not appear at the TRSZ, thereby evading mobilization.

During the trial, the defendant confessed his guilt and expressed remorse. He claimed he did not remember receiving the call-up and signing the corresponding document and also stated that he did not come for the subsequent summons due to fear of immediate mobilization.

The defense requested the court to lighten the sentence considering the confession of guilt, the fact that he has three children, and applied for approved deferment. However, the court found the man guilty under Article 336 of the Criminal Code of Ukraine and imposed a sentence of three years of imprisonment.
