The fine from the TCC will double: what to do to avoid double punishment.
If you are a conscripted person and received a fine from the TCC and the SP, you have the option to pay it in full within 10 days or file a complaint. If you do not do this, the amount of the fine will be doubled. Lawyer Vladislav Deriy explained this.
Increase of the fine from the TCC and SP
'After receiving the decision, you have ten days to contest it in court. If you do not file a complaint and do not transfer the funds, the TCC will send the case to the state executor. As a result, the amount of the fine will double, and the bank accounts will be frozen,' – the lawyer said.
Fines can be imposed on those who do not comply with military registration rules or mobilization legislation, for example, do not update their military data or do not appear in response to a summons.
In the case of martial law, the amount of the fine from the TCC and SP ranges from 17 to 25.5 thousand hryvnias, but it can be higher for officials and legal entities. Offenders may be declared wanted and taken to the military enlistment office by a notification group.
Failure to appear for a summons can be paid online through the 'Reserv+' application. This function is currently in beta testing.
It is also worth mentioning that in Ternopil region, the TCC fined a man with disabilities, but he was able to successfully appeal the fine in court.
For violations of military registration or mobilization legislation, fines from the TCC and SP may arise. If you receive such a punishment, think immediately about cooperating with a lawyer or the possibility of appealing.
