Martial law is not an obstacle for Ukrainians to own land

Ukraine is under the introduced regime of martial law, which has led to restrictions on the privatization of land plots. However, there are several exceptions when it is possible to obtain land even now. In particular, Article 121 of the Land Code defines the right of citizens to receive land for free. Thus, people have the opportunity to obtain a land plot for agricultural farming, private farming, horticulture, construction of residential houses, utility buildings and structures, individual dacha construction, and building individual garages of established size.

The conditions for the free transfer of land plots are established by the Land Code and apply to all types of land use. In particular, a person can privatize up to six land plots according to the types of use listed in the Land Code.

However, it is worth noting that during martial law, it is prohibited to transfer state or communal land plots into private ownership, as well as to issue permits for the development of documentation for the free transfer of land. However, this restriction does not apply to property owners located on land plots, as well as citizens who have already been granted land plots before the Land Code of Ukraine came into effect.
