Tenants are not allowed to prohibit fishing: when you can catch fish in ponds.
Fishing remains one of the most popular forms of recreation in Ukraine. However, some ponds are owned by temporary tenants who can restrict access to them. This often raises the question: do these tenants have the right to prohibit fishing in such waters or even charge for it.
Regarding whether Ukrainians can prohibit fishing in the ponds they rented, it is mentioned on the website of the Serhiyivka rural territorial community.
Is it legal to prohibit fishing in rented ponds
The Ukrainian Water Code provides for two types of water usage: general and special. General usage gives people the right to fish for themselves, swim, use boats, etc. In rented ponds, the tenant's rules apply, which are established jointly with the authorized body. If there are no rules, fishing can be done without restrictions. Therefore, it is recommended to clarify the terms of use before going to a rented pond.
Where in Ukraine is fishing prohibited
According to legislation, any citizens of Ukraine, foreigners, and stateless persons can fish for recreation, except in certain places and bodies of water. For example, fishing is not allowed in nature conservation areas, special fish farms, or bodies of water designated for specific purposes, such as drinking or technical use. In publicly accessible waters, fishing can be done for free, and in the waters of public associations — only with special permit cards.
Ukrainian laws clearly regulate the conditions for fishing in rented and publicly accessible ponds. Fishing can be done for free in publicly accessible waters, but in private ones, owned by the tenant, it is important to adhere to the rental conditions and not to abuse your rights in order to maintain a balance in the use of natural resources.
