On the 'Nord Stream 2' case. The EU Court has put a period on the 'i'.
The Court of Justice of the European Union rejected the lawsuit of Nord Stream 2 AG, which is the operator of the 'Nord Stream 2' gas pipeline, regarding the unbundling of gas transport pipelines. This became known from the court's ruling.
In the lawsuit, the Swiss company, which is a subsidiary of the Russian 'Gazprom', demanded the application of exemptions regarding the unbundling of the gas supply system that apply to pipelines that were completed before the adoption of the EU Gas Directive on May 23, 2019.
The court noted that Nord Stream 2 AG invested in the project without guarantees that EU legislation would not apply to the pipeline. The company could foresee that EU institutions and individual member states would apply internal market regulations to pipelines from third countries, such as 'Nord Stream 2'.
The Court's ruling confirmed that the EU legislative bodies did not violate the principle of legal certainty. The directive clearly states that exemptions can only apply to pipelines completed before May 23, 2019. Furthermore, the actions of the EU do not contradict the principles of equal treatment and proportionality.
The EU Gas Directive requires the separation of gas transportation operations from other types of activities at the ownership level, as well as providing non-discriminatory access for third parties to the gas transmission system.
Explosions on the 'Nord Stream' and 'Nord Stream 2' pipelines
Recall that on September 26, 2022, three of the four pipes of the 'Nord Stream' pipeline were blown up. As a result of the explosions on the 'Nord Stream' and 'Nord Stream 2' pipelines near the island of Bornholm in the Baltic Sea, leaks began in four sections of the pipelines in the exclusive economic zones of Denmark and Sweden.
The Russian dictator Vladimir Putin was convinced that the explosions on the pipelines were orchestrated by US intelligence services.
By the way, German investigators discovered traces of underwater explosives in samples taken from a yacht that, according to the investigation, may have been used to blow up the 'Nord Stream' pipelines.
