What the Law Says About Military Recruitment Staff Entering Private Residences
According to Novyny.live: Under Ukrainian law, personnel from Territorial Centers for Recruitment (TCRs) are strictly prohibited from entering private homes or apartments without a court ruling. Access to a residence is only lawful when authorized by a ruling from an investigative judge—this applies even in cases where TCR officers are accompanied by police. Government Resolution No. 560 does not grant recruitment center representatives any right to visit citizens' homes.
It is important to note that police may enter a dwelling without a court order only in exceptional, emergency situations. If someone attempts to force their way into a home, citizens are advised to call 102 immediately.
Volodymyr Pishchyda, an expert in this field, stated: 'If police and TCR staff show up at your apartment or house without such a ruling, no one can force you to open the door.'
Limits on TCR Staff Authority
Additionally, while TCR employees are allowed to board public transport vehicles, their powers regarding private spaces remain tightly restricted. Pishchyda further emphasized:
'If the TCR list includes conscripts who are required to report for a military medical commission but fail to do so, the proper step is to issue them a summons for the commission. Asking police to accompany them into someone's home, however, is something TCR staff have no right to do.'
These legal provisions clearly define the boundaries of TCR staff access to private residences, aiming to protect citizens' rights. Such rules establish a legal framework to prevent abuse by state authorities and uphold individual privacy. During wartime, it is especially critical for citizens to be aware of their rights and know how to respond when those rights may be violated.
