Requirements for the height of fences between adjacent plots
Lawyer Yuliya Yurchenko from 'Maxim Boyarchuk and Partners' explained that landowners are allowed to install fences on both sides of their territory, but there are certain restrictions in the law.
According to the resolution of the Cabinet of Ministers of Ukraine dated June 7, 2017 No. 406, constructing fences for private houses is possible without obtaining a special permit. However, it is necessary to comply with the established norms regarding height, which are enshrined in construction norms and land legislation.
According to Ukrainian land legislation, landowners must use their land in such a way as not to cause any undue inconvenience to neighbors due to shadow, smoke, smells, or noise.
In case of violation of neighbors' rights or non-compliance with legal norms, the affected party has the right to apply to the court to protect their interests. It is important to consider the interests of both parties when establishing fences to avoid future conflicts and maintain peaceful relations with neighbors.
