A "special" regime for certain agrarians introduced in Ukraine: what it means.
The Cabinet of Ministers of Ukraine introduced an export support regime during the period of martial law. This regime provides for the peculiarities of carrying out export operations of certain types of goods, particularly agricultural products. For this purpose, on October 29, 2024, the Government adopted the relevant resolution, as reported by the Ministry of Economy.
"According to the Economic Security Bureau and the State Tax Service, over 5 million tons of agricultural products worth over UAH 50 billion were exported in the first 8 months of this year, with signs of risk of non-return of foreign exchange earnings. Therefore, in order to minimize schemes of violation of Ukrainian legislation during the export of certain types of goods, to bring a significant part of the economy out of the shadows and increase revenues to the State Budget, the Government is introducing an export support regime for some categories of agricultural products," explained Deputy Minister of Economy - Trade Representative of Ukraine Taras Kachka.
According to him, the export support regime will provide for:
- export of goods exclusively by registered value-added tax payers;
- setting minimum export prices for goods subject to the export support regime. The difference between the invoice and customs value of goods should not be negative;
- electronic exchange of information between the National Bank, the State Tax Service, and the State Customs Service to monitor and control exporters' compliance with legal requirements;
- features of drafting tax invoices and their registration in the Unified Register of Tax Invoices.
The export support regime will concern products defined by the Law of Ukraine "On Foreign Economic Activity", in particular: honey; nuts; wheat and mixture of wheat and rye (meslin); rye; barley; oats; corn; soybeans; rapeseed; sunflower seeds; soybean oil; sunflower oil; rapeseed oil; oilcake.
The resolution will come into force 30 days after alignment and the adoption of all necessary subordinate regulatory legal acts.
