Deferral from mobilization can be arranged by mail: what to do in case of refusal from the TCK.
According to current legislation, a conscripted citizen can obtain a deferral from mobilization in two ways: by personally visiting the territorial recruitment center or by sending documents by mail.
This was written by lawyer Yuriy Ayvazyan on the 'Yuristy.UA' portal.
Arranging a deferral by mail
One conscripted citizen asked lawyers about the possibility of obtaining a deferral from mobilization by sending documents by mail. The man was interested in whether this could be done this way and whether the TCK would refuse the deferral due to submitting documents by mail.
'A refusal for deferral in the case of sending an application with documents by mail is illegal,' lawyer Yuriy Ayvazyan explained to the citizen.
The lawyer noted that TCK rarely makes such decisions in this situation.
Will the case go to the appellate court?
Ayvazyan also explained what to do in case of refusal for a deferral for a citizen who sent documents by mail.
'If the matter reaches court and the court makes a favorable decision, this will be sufficient for the TCK to execute it immediately,' the lawyer emphasized.
According to the lawyer, it is likely that the conflict will not reach the appellate court.
'So, it seems there is no need to go to court a second time. In my practice, such cases have not occurred,' Ayvazyan noted.
The 'Yuristy.UA' portal reported that a conscripted citizen can arrange a deferral from mobilization through personal visit or by sending documents by mail. Lawyer Yuriy Ayvazyan explained that refusal of deferral due to mail is illegal, therefore, cases of such refusals are rarely encountered. He also assured that if the case does go to court, the decision made by this body should be executed immediately, and it is likely that the case will not reach the appellate court.Read also
