According to Novyny.live: Starting in 2024, individuals raising minor children on their own must obtain a court decision to qualify for a deferment from military mobilization. This requirement stems from Resolution No. 560, adopted by the Cabinet of Ministers of Ukraine in May 2024, which outlines deferment eligibility for conscripts based on various family circumstances.
Updated Conditions for Obtaining a Deferment
Under the revised regulations, parents with three or more minor children, as well as those who are sole caregivers for a minor child, are exempt from conscription. To apply for the deferment, they must submit a birth certificate along with a set of supporting documents. A key new condition is proving sole custody in court, which is now mandatory.
According to Vladyslav Deriy, 'Unfortunately, under the current rules (Resolution No. 560), a mother’s statement and a certificate of residence with the child are no longer sufficient.'
Documents that can establish sole custody include:
- a death certificate for one parent,
- a court ruling declaring one parent deceased,
- a court ruling terminating one parent’s parental rights,
- a court ruling recognizing one parent as missing,
- a court sentence showing one parent is serving a prison term,
- a court decision confirming the fact of sole childcare.
Consequently, the updated deferment rules for single parents now demand legal confirmation, which could pose significant challenges for those seeking this exemption.
These new requirements may affect many single parents striving to support their children under difficult circumstances. The need for a judicial ruling to prove sole custody could create a substantial barrier, as not everyone can quickly or easily obtain the necessary documents. This situation might heighten social tensions among affected citizens and increase the demand for legal assistance.
