Ukrainian Soldiers Face Legal Hurdles for Mobilization Deferral After Contract Ends.
Deferral Rights for Demobilized Personnel
According to Novyny.live: Ukrainian Armed Forces personnel whose contracts expire during wartime are entitled to a deferral from mobilization. However, securing this right may require them to go to court. For instance, one soldier's contract is set to end in February, highlighting the critical need for service members to understand new legislative proposals. This legal landscape is evolving rapidly as Ukraine continues its defense against the ongoing invasion.
Legislative Changes and Their Practical Impact
Draft Law No. 14283, designed to improve the legal standing of military personnel, grants them the right to a mobilization deferral. Attorney Vyacheslav Kyryda confirmed that soldiers can utilize this right, stating:
“Yes, you will acquire the right to a deferral, as the Law has retroactive force in cases where it improves a person's situation.” - Vyacheslav Kyryda
Nevertheless, attorney Yuriy Ayvazyan noted that if disputes arise, “you may have to defend your right to a deferral in court.”
Consequently, service members concluding their contracts during the war must be prepared for potential difficulties in exercising their rights. Despite legislative backing, the prospect of navigating court procedures presents an additional challenge during an already demanding period. The situation underscores the vital importance of legal awareness among troops, as shifts in legislation can significantly affect their duties and entitlements. The urgency of these legal clarifications points to possible implementation issues with the new norms, which may, in turn, necessitate extra efforts to protect one's rights.
