No Automatic Deferment for Soldiers After Contract Ends: When Court Intervention Might Apply.
Deferment Rules for Contract Service Members
According to Novyny.live: Military personnel who sign a service contract will not automatically receive a deferment once that contract concludes. A deferment is only possible through a court ruling, and even then, a positive outcome is not guaranteed. This clarification emerged after inquiries from conscripts seeking to understand their rights upon completing their term of service.
According to available information, a one-year deferment is granted exclusively to participants of a specific contract program. Furthermore, only those conscripts who can provide documented evidence of eligibility may apply for such a deferment. For instance, a 24-year-old citizen finishing a three-year contract asked about his entitlement to a deferment and was informed that no automatic deferment is provided after completing the 3-year term.
Yevhen Korniychuk, a military service expert, stated: 'After completing a 3-year contract, you can leave the service, but leaving itself does not automatically grant a deferment—neither for one year nor until age 25.'
He further emphasized that 'you can only obtain a deferment through court proceedings, and even that is not certain.' Regarding the one-year deferment, the expert noted that 'such a guarantee is not available to all service members aged 18–25.'
Consequently, conscripts who finish their contract service may be placed in the operational reserve after discharge, but this does not guarantee them an automatic deferment. The situation calls for additional clarification for service members planning to end their service.
This information highlights the importance of understanding the rights and obligations of military personnel completing contract service. At a time when many young people are serving in the armed forces, it is crucial that they are informed about potential legal consequences and procedures related to deferments. Given the complex circumstances that may arise after service, such knowledge can be critically important for those planning their future beyond the military.
