'If the owner tries to unregister a person who has legal grounds to reside there, this can be challenged in court,' explains lawyer Tetiana Petryk.

What documents are needed for cancellation of registration

To carry out the procedure, the owner or an authorized person must submit the following documents to the CNAP or registration authority:

  • passport or ID card of the applicant;
  • document confirming ownership of the property;
  • application for removal from registration;
  • court decision or other document confirming the grounds.

If it involves removal without the person's consent, a court decision or an official document from a government agency is mandatory.

How the registration cancellation procedure works

The process consists of several stages:

  1. Submission of application and documents.
  2. Verification of grounds by the registration authority.
  3. Decision making and changes made in the register.
  4. Issuance of a certificate of removal from registration to the applicant.

The procedure usually takes from 1 to 3 working days, but in cases involving a court decision, the process may take several weeks.

Features of forced removal from registration

Forced removal is possible only after proving in court that a person has lost the right to use the property. For example, if a person has not lived in the apartment for a long time without valid reasons, or if the tenant violated the terms of the contract.

Lawyers advise owners to act cautiously to avoid accusations of human rights violations.

'Even if a person has moved out a long time ago, they may still have legal grounds for residence. Incorrect actions by the owner may lead to prolonged legal proceedings,' notes Petryk.

What are the risks of canceling registration

After removal from registration, a person loses the right to use the property and may also lose access to certain social services tied to their place of residence.

In cases involving minors, the procedure has additional restrictions: a child can only be removed from registration after registering at a new address.

How to protect your rights during registration cancellation

If you receive a notice of intent to remove you from registration, it is important to respond promptly. You need to check the grounds, gather evidence of the right to use the property, and, if necessary, consult a lawyer. You can challenge an unlawful removal in court.

It should be noted that, according to legislation, there remain certain categories of citizens who cannot be deprived of registration without meeting specific conditions.

There is also a common misconception that residence registration in Ukraine automatically grants the right to inheritance, which is false. In fact, registration is not a basis for obtaining a share of real estate. It may be significant, but in other aspects of inheritance law.
