The Ministry of Internal Affairs mistakenly included a man in the criminal database: the court awarded compensation.
The man went to court due to the Ministry of Internal Affairs' mistake, which prevented him from working in his profession and obtaining a weapon permit. As a result of this situation, he sought compensation for moral damages.
According to court documents, in 2018 the man was denied a weapon permit because he had previously been prosecuted. However, the prosecution acknowledged that this information was erroneous and corrected it in 2021.
Although the man could have worked in the fields of law and trade management, he was unable to do so due to the refusals he received from employers and being registered at the Employment Center.
The court's decision
As a result of the case review, the appellate court found that the man was entitled to compensation for material damage caused by the unlawful actions of the Ministry of Internal Affairs. Despite the fact that he will not receive two million hryvnias, 20 thousand hryvnias will be collected from the budget in his favor.
As a result of the violations by the Ministry of Internal Affairs, the man suffered moral and material harm, but the court decided to recover only 20 thousand hryvnias from the budget in his favor.
