Monetary Compensation for Unused Vacation Time in Ukraine
According to Novyny.live: Ukrainian labor law provides for financial compensation for unused vacation days upon dismissal and in other specific situations. The State Inspectorate for Labor Affairs in the Kharkiv region has clarified the grounds for receiving this compensation and the rules for its calculation. This system is a key part of employee rights, ensuring workers are paid for earned time off they could not take.
Compensation is paid when an employee is dismissed, covering all unused days of annual leave. It also applies to additional leave entitlements, such as for employees with children or an adult child with a childhood disability of subgroup A, group I. A crucial condition is that compensation is only available if the employee has already used at least 24 days of their annual leave in the relevant period. State employees are also entitled to compensation for unused annual leave upon termination of their service.
Rules for Receiving Compensation
Employees called up for military service may also be compensated for all unused annual leave days. The calculation is performed by multiplying the employee's average daily wage by the number of unused vacation days. The average daily wage is determined by dividing the total income earned during the reference period by the number of calendar days in that period.
To claim this payment, the employee must submit a written application to their employer no later than the last day of the month in which they were dismissed. These procedures safeguard workers' rights to financial compensation for accrued leave and help uphold their legal protections in the workplace.
