Mobilization for Persons with Disabilities: In Which Cases Is It Possible.
According to ТСН: In Ukraine, there is a deferment from mobilization for certain groups of citizens, including persons with disabilities. However, there are some exceptions.
Which Persons with Disabilities Are Exempt from Mobilization?
According to Article 23 of the Law of Ukraine on 'Mobilization Preparation and Mobilization', persons with disabilities are not subject to conscription even during wartime. There is no specific disability group that provides a deferment — the mere fact of having such status ensures temporary exemption from mobilization.
However, it should be emphasized that a person with a disability can be mobilized on a voluntary basis. If a man wishes to go to the front and has no serious health problems, he can sign a contract and join the Armed Forces of Ukraine.
Procedure for Obtaining a Deferment
Mobilization of persons with disabilities is possible if they have the appropriate status, but the deferment is not formally registered. Previously, it was necessary to visit the TCC, but now, starting in November, for initial registration it is necessary to contact the CNAP. After that, employees will send all the necessary documents to the TCC: military registration document, MSEC certificate (form 157-1/o), as well as copies of the code and passport.
The subsequent stages of obtaining a deferment take place without the participation of the citizen. After approval, the application is confirmed in the 'Reserve+' app approximately within a week.
Duration of Deferment
The terms of deferment depend on the severity of the person's illness. Some men may remain non-conscription for life, while others must undergo health re-evaluation every six months or a year. If they are deemed healthy during the follow-up examination, the right to exemption from mobilization will expire, and they will be recognized as fit for service.
The deferment due to disability in 'Reserve +' is automatically extended. If the grounds for obtaining it remain, the person will receive a notification through the app.
It is also worth noting that martial law in Ukraine has been extended until February 3, 2026. Mobilization will continue from December 1 and does not foresee changes in the process. The current rules and procedures for mobilization remain unchanged and are regulated by the legislation of Ukraine.
