Mobilization of Men Under 25 Previously Deemed 'Limited Fit' Still Possible as Law Awaits Presidential Signature.
Ukraine's Law 3939-IX on Mobilization
According to Novyny.live: Ukraine's parliament passed a bill in 2024—Law 3939-IX—that addresses the mobilization of individuals who were formerly classified as 'limited fit' for military service and are now under 25 years old. The legislation explicitly prohibits drafting men in this category. However, as of now, President Volodymyr Zelenskyy has not yet signed it into law, leaving its enforcement in question and creating legal limbo.
Legal Conflict and Its Consequences
Lawyer Yuriy Ayvazyan has pointed out that Directive No. 11379d, which was meant to resolve this legal contradiction, does not carry the weight of a normative legal act. He stressed that despite the parliament's approval, without the President's signature the law has not taken effect.
“In October 2024, the Verkhovna Rada adopted Law 3939-IX, which bans the mobilization of men under 25 who had previously been classified as limited fit. Yet to this day, the President has not signed it, so it remains inactive,” Ayvazyan stated.
As a result, citizens under 25 with a 'limited fit' status are technically allowed to leave the country under martial law. However, Ayvazyan cautioned: “Unfortunately, without an official deferment, as a person liable for military service, you are subject to mobilization regardless of your age.” The situation is unresolved, and the next steps depend entirely on the President's decision.
The passage of Law 3939-IX, which aims to protect a specific group from conscription, suggests the state is trying to modernize military regulations. Yet the absence of the President's signature complicates implementation and fuels uncertainty among those affected. Men who fall under this law remain in a precarious position, which could impact their travel plans abroad and add to the emotional strain of wartime.
