Adult children are obliged to support their parents: who has to pay alimony

It is known that the responsibility for minors falls on their parents. They must provide for them financially, as well as contribute to their physical, moral, and intellectual development. At the same time, according to the law, adult children must care for their disabled parents.

The website of the Obolonska rural territorial community reported on when children are obliged to care for and financially support their parents.

When the obligation to support parents arises

According to the Constitution of Ukraine, adult children must support their parents if they cannot work due to health reasons or other factors.

According to the Family Code of Ukraine, a son or daughter is obliged to financially support their disabled parents who require assistance. The responsibilities of adult children include regular alimony payments and covering additional expenses related to treatment, disability, or other health issues of the parents. The obligation to support is placed solely on adult children - the son or daughter.

Who can expect financial support from their children

Entitlement to financial support is granted to disabled parents who have reached retirement age or have a disability, and who cannot independently support themselves due to low pensions or a lack of income.

In case of refusal to support, parents can appeal to the court at the place of residence of either party. The court may exempt children from the obligation to provide support if it is proven that the parents evaded their responsibilities or did not pay alimony for the children.

In Ukraine, legislation clearly defines the duties of adult children regarding the care and financial support of their disabled parents who require assistance. This is aimed at ensuring a decent life for elderly citizens and those with health or ability limitations. In case of refusal or failure to perform these duties, legal consequences may follow.
